Magnolia Tours Terms & Conditions

Introduction

The purchase of any travel services offered by Magnolia Tours authorized to do business as Magnolia Tours constitutes a contractual arrangement between the tourist (“the Client”) and Magnolia Tours, and represents your acceptance of the Magnolia Tours Terms & Conditions set out herein.

Please ensure that you carefully read and understand these Terms & Conditions before making your booking. You are advised to check on our website or to request the latest version of the Terms & Conditions from Magnolia Tours.

The client must at all times comply with all South African laws, regulations and any other regulations applicable. The client must strictly abide to the following rules during the tour:

  • No drugs or any other intoxicating substances of any nature whatsoever are permitted on our tours.
  • Any disruptive, dangerous or potentially dangerous behavior during the tour shall not be tolerated and that Magnolia Tours reserves the right to exclude the client from the rest of the tour at any point wherein such circumstances arise. (Magnolia Tours shall not be held liable for any costs and or/expenses incurred for by the client as a result of the client being excluded as aforesaid, and the client shall not be entitled to a refund or rebate of the tour price or and additional compensation in such instances).

Tour Price and Payment

  • The tour price is as stipulated on the website or invoice provided to you by Magnolia Tours (“Tour Price”).
  • Full payment of the Tour Price is due 30 days prior to the tour. Your booking will be automatically cancelled if the full payment or the balance thereof is not received.
  • Tour payment can be done directly on our website, or upon request Magnolia Tour will send an online payment link to client via Payfast, PayPal or Yoco.
  • The Tour Price includes all services, meals that are included as per the itinerary.
  • Proof of payment for the Tour Price must be emailed to info@magnoliatours.online. Magnolia Tours will confirm the booking via email once the full payment has been received.
  • All prices are stipulated as per person unless stated otherwise.
  • Prices are subject to change without prior notice.
  • The Tour Price is in South African currency being ZAR. If payment is in any other currency the amount paid in a foreign currency should be equal to the Tour Price after currency conversions have occurred.
  • Some tour prices are NOT meant for peak season period; as domestic travel demand goes higher.
  • In order to secure your booking a (non-refundable) deposit of 50% is required by the date that will be given in your quotation. A booking is confirmed once required deposit is received. The balance shall be paid before the commencement of the tour.
  • Itinerary on the website is NOT final, Magnolia Tours reserves the right to mend/change itinerary when necessary.

Cancellation & Refund Policy

  • All cancellations must be made in writing to Magnolia Tours immediately after such decision has been reached.
  • If it rains or weather doesn’t permit for tour to continue your reservation will be rescheduled or you will receive a refund.
  • Magnolia Tours reserves the right, at any time and for any reason it deems reasonable, to cancel the tour on notice to the client. In such event Magnolia Tours will refund all funds paid by the client.
  • The tours are subject to a minimum of 2 people an extra charge will apply for single travelers.
  •  If the client does not complete the tour with the rest of the group, for any reason whatsoever, he or she shall not be entitled to any refunds/ reschedule whatsoever.
  • No cancellation fee is applicable to tours cancelled more than 60 (sixty) days prior to the tour date.
  • Should the client cancel a booking within 30 (thirty) days or less prior to tour date for any reason (except hospitalization), the client will be liable to pay cancellation fees as follows:

Day Tours: 

  • 30-days’ notice: full refund client forfeits transfer costs/bank charges.
  • 21-days’ notice: client forfeits 50% of full payment.
  • 11-days’ notice: client forfeits 100% of full payment.
  • NO SHOW on the day of tour departure, client forfeits 100%.

Multi day Tours:

  • 30+ days’ notice: full refund client forfeits transfer costs/bank charges.
  • 21 days’ notice: client forfeits 50% of the Tour Price.
  • 11 days’ notice: client forfeits 75% of the Tour Price.
  • 0-7 days’ notice: client forfeits 100% of the tour price.

Departure Times

Magnolia Tours, its owner, employees, agents and affiliates cannot be held liable for delayed flights or transfers that negatively affect a tour booked through the company. Suppliers that provide transfer services for our tours adhere to strict departure and arrival times, and may be forced to leave without a client(s) who has been delayed en route to the collection point. The client will be liable for all additional cost in this case if Magnolia Tours has to organize a private transfer or book an extra day to make up for time lost on the tour.

Passports, Visas and other Travel Papers

It is the responsibility of the client to ensure that passports, visas, health certificates, proof of vaccinations and any other required documentation are all in order before the tour date.

Under no circumstances will Magnolia Tours write any Visa invitation letters what so ever.

Insurance

  • We strongly recommended that clients obtain adequate insurance against cancellation, loss of baggage, medical evacuation, medical expenses and the unforeseen circumstances of Magnolia Tours.
  • It is the client’s responsibility to have travel insurance and present it before travelling on our tours.
  • Travel insurance must include comprehensive medical insurance and Magnolia Tours shall not be liable for any consequences, damages or loss as a result of the client failing to have the necessary cover.

Baggage/Luggage

  • The client shall be responsible for his/her baggage or luggage and personal items on tour.
  • Magnolia Tours will not be liable for any loss or damage to such baggage/luggage or any personal items.

Sharing of rooms/meals

  • It is the responsibility of client to provide Magnolia Tours with a rooming list prior to the start of the tour.
  • It is the client’s responsibility to let Magnolia Tours know of any dietary requirements.

Health

  • The client hereby irrevocably accepts to participate in a test of physical fitness and health to measure the client’s physical fitness and health.
  • The client is obliged to ensure that he/she is medically & physically fit to embark on the tour.
  • Magnolia Tours will not be held liable for any medical costs or expenses (direct, indirect or consequential) that might be incurred by the client during the tour due to the client’s health and physical fitness not being on a standard required for the tour.

Unforeseen circumstances

  • Unforeseen circumstances including mechanical breakdowns, weather, riots and other events of force majeure, which are beyond the control of Magnolia Tours may cause delays or alterations to the tour and/or the tour schedule.
  • Magnolia Tours shall not be liable (directly or indirectly) in any way for any of these possible occurrences or any consequences, which may arise as a result thereof.

Indemnification and exclusion of liability

  • The client is aware of the different health, weight and age restrictions required for certain activities; Magnolia Tours will not be held responsible for any refunds/cancellations of activity should client not be permitted for an activity due.
  • The client accepts that some of the tours is of an adventurous nature and involves an element of personal risk.
  • While every care is taken, Magnolia Tours and its representatives and agents shall not be liable for any loss or damage of whatsoever nature and howsoever arising (including, but not limited to, the clients or any other persons injury or death, or any loss or damage to the client’s or any other person’s property) which the client or any such other person may incur or suffer as a result of or arising from the client’s participation in the tour and any other activities undertaken on or during the tour, and the client hereby irrevocably and forever releases and discharges Magnolia Tours and its representatives and agents from any and all such liability.
  • The client furthermore indemnifies and holds Magnolia Tours and its representatives and agents harmless from and against any and all loss, damage, actions, proceedings, claims, demands and legal and any other costs and expenses (including legal costs on an attorney and client costs) of whatsoever nature and howsoever arising (including, but not limited to, the client’s or any other persons injury or death, or any loss of or damage to the Tourist’s property) which the client or any other such person may incur or suffer as a result of or arising from the client’s participation in the tour and any other activities undertaken on or during the tour.

 

 

CANCELLATION & REFUND POLICY FOR DAY TOURS

An indemnity form for each person within the travel group must be completed, signed and returned to the Magnolia Tours agent prior to the tour departure date. If Magnolia Tours has not received the indemnity form(s) before the date of departure, we reserve the right to cancel the booking with no obligation to refund the client his/her payment.
